Leader Thune filed cloture on the nomination of Stephen Miran, of New York, to be a Member of the Board of Governors of the Federal Reserve System for the unexpired term of fourteen years from February 1, 2012.

Agreed to, 51-45: Motion to reconsider the failed cloture vote on Executive Calendar #1, S.Res.377.

Leader Thune made a point of order that the threshold for cloture on Executive Resolutions should be a simple majority.  The Chair ruled the threshold is 60 votes. Thune appealed, and the Senate voted on whether the decision of the Chair shall stand.

Not Sustained, 45-53: Shall the decision of the Chair stand as the judgement of the Senate in relation to the cloture threshold in relation to Executive Calendar #1, S.Res.377.

Invoked, 53-43: Motion to invoke cloture on S.Res.377, upon reconsideration.
